No consultancy in residential areas, HC tells engineers
Express News Service
New Delhi, March 12: UNLIKE doctors or chartered accountants, consultant
engineers will not be allowed to run offices from properties in
residential areas. The Delhi High Court, in a recent order, drew the
line for professionals, refusing to stay demolition of office properties
in residential areas owned by engineers.
The order came as the National Foundation of Indian Engineers approached
the division bench, seeking to spare their offices from the MCD’s
demolition drive. The court, however, came down heavily on engineers,
saying: ‘‘Why should you be exempted from the demolitions? You engineers
are the main persons responsible for creating a havoc in Delhi by
designing...unauthorised and illegal structures.’’ The engineers of the
Municipal Corporation of Delhi (MCD), the bench headed by Justice
Vijender Jain said, were responsible for the mushrooming of unauthorised
structures. ‘‘It is because of you that the city is in such a mess,’’
the judges said.
The bench then went on to reject the engineers’ plea that their offices
be kept out of the demolition drive, on the lines of the relaxation
given to professionals like chartered accountants, doctors and lawyers.
Presently, professionals can earmark 25 per cent of their property in
residential areas for work-related purposes.

Citing the exemptions granted to the three group of professionals, the
association sought a similar exemption on the ground that engineers too
were professionals engaged in expert services."
