SC Committee recommends contempt proceedings against MCD, PC

The Supreme Court appointed monitoring committee in its fresh report filed in the court has recommended initiation of contempt of court proceedings against MCD commissioner A K Nigam and Delhi Police commissioner K K Paul for not resuming the sealing of about 41,000 commercial premises who had filed affidavit of undertakings.

The monitoring committee has recommended to the Supreme Court that since the Municipal Corporation of Delhi (MCD) and Delhi police are deliberatly flouting the directions of the court given in its order dated September 29 directing the MCD to resume the sealing of premises operating from residencial areas in Delhi.

Despite having given an undertaking to the court that the traders would cease their commercial activities on their own latest by June 30, 2006 and the deadline being finally extended till October 31, the sealing was NOT resumed from Novomber 1.

It could not be resumed due to the traders agitation and the monitoring committee had directed the MCD to start sealing from today.

The police commissioner was also told to provide security to the MCD officials on sealing duty but the process was not resumed by the authorities on the grounds that their may be a serious law and order problem.

The Supreme Court is going to hear the applications filed by the centre, Delhi govt and MCD seaking to defer the sealing process on November 6.

The Court is also likely to consider the recommendations of the monitoring committee.

Govt defers sealing drive in New Delhi

NEW DELHI: Citing law and order problems, the government said yesterday it will not be able to start the sealing drive against illegal commercial establishments in residential areas in the Indian capital till Monday.

The government’s position was stated by a high-powered Group of Ministers (GOM), headed by External Affairs Minister Pranab Mukherjee, which also decided to approach the apex court again seeking compensation for over 44,000 affected traders.

"The Municipal Corporation of Delhi (MCD) will approach the Supreme Court will and apprise it of the difficulty on the ground in carrying out sealing in the present tense situation," Urban Development Minister Jaipal Reddy told newsmen here after the meeting.

The court appointed monitoring committee wrote a letter to the civic authorities to resume sealing drive, but the government said it was difficult to do so at present.

"Its difficult to conduct sealing in Delhi. The situation is tense," Urban Development Minister Jaipal Reddy told reporters after the GoM meeting.

The GoM also decided to approach the apex court again seeking compensation for over 44,000 affected traders.
