the DUAC, could you please elaborate on [a] why and how is the legality of
the MPD-2021 being questioned; [b] what makes the DUAC's activities on
MPD-2021 legal or illegal?

Couple of FAQs:
WHO ARE CHARLIE'S-ANGELS? Charlie chairs a Delhi Urban Art Commission
having 4 other members (maximum size that DUAC can be) and 9 Standing
Sub-Committees to help with approvals, 13 Taskforces for Imagining-Delhi,
at least one other Strategy Group with 2 dissolved and 3 undissolved
taskforces, consultants for suo-motu studies, etc. Except the
GOI-appointed DUAC members (Mohd Shaheer, Jasbir Sawhney, Narayani Gupta
and MM Kutty) and ex-officio members of the Strategy Group (constituted
'with a view to achieving greater coordination and interaction between'
DUAC and various agencies of Delhi), all other persons currently
associated with DUAC are Charlie's Angels as follows: S.8(1) of DUAC Act
1973 provides that the DUAC may associate with itself, in such manner and
for such purposes as may be determined by regulations, any person whose
assistance or advice it may desire in carrying out any of the provisions
of this Act. S.27(2)(b) provides that the DUAC may make regulations
consistent for regulating the manner in which and the purposes for which
persons may be associated with the Commission under S.8. DUAC has not made
any Regulations under S.27(2)(b) and has duly informed that decisions to
associate persons were simply taken by Charlie Commission.
HOW MANY CHARLIE'S-ANGELS POSTS EXIST? There are at least 174 currently
occupied posts, including 59 on standing sub-committees (listed at
<http://duac.org/ria/rianx05_pg1.htm>) and 115 on Imagining-Delhi
Taskforces (listed at <http://duac.org/ria/rianx06_pg1.htm>). DUAC has not
yet disclosed complete information about persons associated with it.
HOW MANY ANGELS FILL THE KNOWN CHARLIE'S-ANGELS POSTS? 92 Angels fill the
known 174 Charlie's-Angels posts.
WHICH ARE CHARLIE'S EMINENTLY BEST-20 ANGELS? The 20 that man between them
74 out of the 174 Charlie's Angels known posts, viz: the 5 Angels manning

whatsoever, which obviously makes the performance of Charlie's best
performing Angels even better).

WHY ARE ONLY A FEW IMAGINING-DELHI PROJECTS MAKING PROGRESS? The Best-20
Angels, who are manning most of Charlie's Angles posts over and above the
various other posts they are manning, obviously cannot handle more. (Also,
on some of the issues recruitment was not complete and other eminent
Angels are being currently recruited. For example, the star performer at
the DUAC-IIC discussions on 31-March-2007 was Dinesh Mohan who is not yet
an enlisted Charlie's Angel).
WHAT ROLE ARE CHARLIE'S-ANGELS OFFICIALLY PLAYING IN MPD-2021? In absence
of the Regulations envisaged in S.27(b) of DUAC Act 1973 it cannot be said
with certainty what role Charlie's Angels are officially playing in
anything. The Role that DUAC itself is playing in MPD-2021 has also not
been officially disclosed: DUAC evaded reply to that question under RTI in
2006 and Charlie himself (and also Jasbir Sawhney) evaded reply at the
DUAC-IIC public discussion on 31-March-2007.
WHAT *CAN* THE DUAC DO ON MPD-2021? DUAC's functions are defined in S.11
of DUAC Act and its role in MPD is defined in MPD-2001 under DD Act.
S.11(1) of DUAC Act provides that it shall be the general duty of DUAC to
advise the Central Government in the matter of preserving, developing and
maintaining the aesthetic quality of urban and environmental design within
Delhi and to provide advice and guidance to any local body in respect of
any project of building operations or engineering operations or any
development proposal which effects or is likely to affect the skyline or
the aesthetic quality of surroundings or any public amenity provided
therein. S.11(2) provides that subject to the provisions of S.11(1) it
shall be the duty of DUAC to scrutinize, approve, reject or modify
proposals in respect of specified matters. S.11(3) provides without
prejudice S.11(1) & (2) that DUAC may suo motu promote and secure the
development, re-development or beautification of any areas in Delhi in
respect of which no proposals in that behalf have been received from any
local body. MPD-2001 Development Code mandated high-level policy committee
for layout plan guidelines with representation of DUAC and its Plan
Monitoring and Review provisions mandated monitoring-based plan revision.
The Role expected of DUAC in MPD-2021 in view of these provisions was to
advice, on basis of DUAC experience on the high-level policy committee
under MPD-2001 Development Code, the DDA in the course of MPD-2021
preparation and the GOI in course of MPD-2021 approval in terms of S.11(1)
of DUAC Act.
ARE DUAC'S ACTIVITIES ON MPD-2021 LEGAL? This question ought to be
answered in context of the question of legality of MPD-2021 itself, which
is complex and appears not to be of interest to anyone. Meanwhile, comment
may be made on separate activities of Charlie's Angels. Several of
Charlie's Angels are named as authors of MPD-2021, which had basis in S.5A
of DD Act (though it is not yet known if those committeefication powers
were legally and properly exercised). In 2005, Charlie's Angels filed
DUAC's objections/suggestions on dMPD-2021 in response to the statutory
public notice inviting public objections/suggestions and in 2006 they
mounted a traveling exhibition and unleashed a media blitz of their
imaginings about MPD-2021, all of which was devoid of basis in DUAC Act
and in conflict with public notice provisions of DD Act. In 2007 Charlie's
Angels are simultaneously claiming their objections / suggestions /
imaginings were ignored and proceeding with projects on the basis of the
significant changes they have introduced into MPD-2021, all of which
displays distinct improprieties if not outright illegalities. There are
also glaring illegalities in Obviously, the activities of Charlie's
Angels on MPD-2021 are separately illegal and improper. However, this is
only so in terms of the laws and norms that Charlie's Angels are
themselves re-writing. In the diabolical heaven in which Charlie's Angels
throng all misconducts have been regularized and shall be haloed (and for
those not inclined to throng along, there shall always be room in the
heavenly hell outside. Amen.)
