Panel report moots more floors, waiver fee

Tejender Khanna Committee recommends four floors be allowed in residential
areas; compound fee to regularise violations

New Delhi, May 15: The Tejender Khanna Committee, appointed by the Urban
Development Ministry to look into the extent and nature of unauthorised
construction in Delhi, submitted its report today. It recommends:
* violations which have taken place within the premises of residential plots
be regularised after charging a compound fee.
* Permit regularisation of unauthorised construction only if it is within
the boundary of the residential plot
* DDA height norm in the city be relaxed by permitting construction of four
floors in residential areas instead of the so far mandated 2.5 floors.
* in DDA-developed colonies (essentially DDA apartment blocks), flat owners
be permitted to make alterations and extensions including additional rooms
and covering and extending of the balcony, as per the need of the owner.
* relax commercial and mixed land use norms beyond what has been proposed in
the DDA's mixed land use policy. This implies that areas (defined as roads
and colonies) which have 100 per cent commercial activity should be declared
as commercial and not just mixed land use areas.
* notification of these roads/colonies, which are to be identified by the
Government only after the Committee report is accepted, can take place only
if there is a provision for parking and specially demarcated pedestrian
pathways.
''This means that cars parked outside shops will no longer be tolerated by
the Government,'' said Ministry sources today.
* encroachment on government land will not be tolerated. Commercial
development on both agricultural land in rural areas as well as in urban
villages or lal dora land will also not be tolerated.
''In case it is absolutely not possible to remove encroachments on
government land or commercial activity in urban and rural villages, then
they are to be regularised after charging a hefty penalty which is the
market rate cost of the plots,'' said Ministry sources.
* Change of land use and subsequent notification by the Ministry should also
henceforth take place only after consultations with the local RWA, traders
in the area, the DDA and the service provider agencies (such as the MCD).
* The Committee has also suggested that a monitoring and regulating body be
set up to ensure that the law is implemented and stringent action is taken
against all officials who have let unauthorised construction come up in
Delhi.

HC to take up demolitions on May 18
The clarification sought by the MCD with regard to the demolition, after
passing of the Delhi Laws (Special Provisions) Bill, 2006 is likely to come
on May 18 when the Delhi High Court will take up the matter related to
demolitions ordered in the city.
